The application of revised Procedure for verification of public procurements carried out by the project partners for Romania-Republic of Serbia IPA Cross-border Cooperation Programme, approved by JMC Decision 63/22.01.2013 is mandatory
The legal basis for application of public procurements procedures for the Romania-Republic of Serbia IPA Cross-border Cooperation Programme is art. 121 of IPA Implementing Regulation and more specifically Decision 2034/2007 and not the PRAG.
It is recommended that beneficiaries indicate art. 121 of the IPA Implementing Regulation and European Commission Decision 2034/2007 as legal basis for your request of publication on EuropeAid website.
If difficulties are encountered with the publication process the beneficiaries shall immediately notify the managing authority in order to tackle the issue with the relevant European Commission services.
Any modification of the European Commission Decision 2034/ 2007 shall immediately produce effects, according to art. 14, para.10 of the subsidy contracts and the beneficiaries must observe those legal provisions.
The beneficiaries shall use the templates from PRAG 2013 for works, supplies and services for the local open tender and international open tender with the thresholds from European Commission Decision 2034/ 2007.
For all other procurement procedures, namely single tender and competitive negotiated procedures for services and supplies, the beneficiaries shall use the templates which are annexed to this procedure, that have been simplified and approved through the initial version of the procedure with the thresholds from COM Decision 2034/ 2007.
